The Start-Up Visa Act would grant permanent residency (green card) to any foreign-born entrepreneur whose new business attracts $100,000 in venture capital and creates 5 new jobs within 2 years. According to the SBA, immigrants are more than 30% more likely to start a business, especially in IT, than non-immigrants. Since the mid 1990's, there's been atleast one immigrant founder in over a quarter of all engineering & technology firms launched in the U.S. including: Google, Intel, Yahoo and eBay.

Vizcaino co-employment case and many companies still needlessly maintain consultant tenure restrictions and rotation policies which are highly inefficient and expensive. Two prominent expert attorneys in federal & state labor laws describe the procedures necessary to minimize re-classification and co-employment risk in the TechServe Alliance white paper, "Microsoft - Understanding the Implications." This will allow companies to retain critical consulting resources and avoid the high costs and project risks of forced labor turnover.

But to effectively track, manage and make it work, a company must be completely metrics-oriented, and most clients simply aren't ready. Vendors too are challenged with this approach, but are scrambling to comply with this growing client requirement.
